In the case of Copilot outputting verbatim code, it first has to be significant enough to constitute a copyright violation. Then, as GitHub is saying Copilot will, Copilot would include attribution in the code, saying where it came from. Then you can check the source and decide.
Have you seen the case highlighted by @mitsuhiko? It produced DOOM code verbatim, no attribution, and with the wrong license.

Yeah the DOOM code in question is definitely novel enough to be covered by copyright. Additionally I don’t think the AI is sufficiently advanced enough to be able to distinguish what code is “significant” enough to be covered by copyright.

The AI could know when it was quoting verbatim. That feature and the attribution feature is not included in this release. Ziegler's paper describes it well. https://docs.github.com/en/github/copilot/research-recitation …
