of course! what i'm trying to get at here is: if my work has the same number of words and the same amount of each word, how similar does the order have to be in order to violate the original author's copyright? and then, of course, why is an """""AI""""" different?

Both results are derived from the original corpus, and the copyright holder of the corpus has rights to the derivative work created through these processes. At least that's my understanding.

I just don't think we know yet. The law on derivative works is based on situations that long predate AI and automation of media. See, e.g., https://www.copyright.gov/circs/circ14.pdf … Short answer: It's going to have to be tested in court.

Not a lawyer, just someone who cares: the doctrine for deciding what constitutes a derivative or transformative work comes from the court, not from legislation. Sometimes precedents differ between circuits, so the answer is not necessarily knowable without going to court.

There's so many ways to look at this. Eg 1/ as a human, reading tons of code, seeing interesting things and learning from it, would code I write using those lessions be a (c) violation? No, not unless I literally copied big chunks. Does Copilot emit literal chunks?
