I would love to see this issue being brought to a court. It's a novel use case for open source software. We didn't really have that on our radar when most of the common licenses were written. IP law experts should put on their gloves and fight this one out.
The problem with this is that when one side is one of the biggest companies in the world, and the other one is thousands of unorganized and anonymous developers, and court case cannot be fair
