It's going to be interesting to see how this all plays out. I imagine if you use Github you've probably agreed to this kind of use already. I can't imagine they released this without the lawyers going over it with a fine toothed comb.
That's actually not their argument; they're saying that any ML training counts as fair use.

Interesting, not a lawyer but that sounds reasonable(ish) to me. I guess it comes down to the difference between ingesting all the code for training vs using tiny snippets at the user end? Presumably Google crawl Github source? Is that similar?
