It’s gonna be really bad if an AGPL project finds this and takes legal action
they contend that it's fair use, so licenses aren't triggered.

Of course they can say anything until their theory meets copyright law in a court. I hope they manage to upset IBM somehow, that's usually a good way to test wild copyright theories against hard reality.
