So repositories like the Unity CS Reference, which is under a really restrictive license....... oh dear i smell lawsuits incoming
they don't think copyright-based licences apply to them, because they contend that it's fair use.

Well, isn't fair use a defense after you've been sued? I didn't think it was a pre-emptive thing.

Fair use is an affirmative defense in the US, yes. (And it doesn't exist at all in most of the rest of the world, although a related concept, "fair dealing", is at play in at least the Commonwealth.)
