This doesn't solve the issue of copilot putting GPL code (or derived code) in a non-GPL repo (since I don't think ToS allowed GH to license your code to others), but copilot itself is probably fine from legal perspective.
Really? Linus and all the kernel contributors, for instance, agreed to that license?

Oh, I was possibly mostly wrong, depending on some interpretation. It seems that you can avoid licensing code to GitHub specifically if the public license it's under allows them to operate their service. The issue is basically if they're "analyzing" or "distributing" though.

(mostly since the question is if GPL allows everything their license does, which after reading it again seems to be the case)
