What on earth do you mean by that? Copilot is proprietary. If it's based on GPL code, it need to be GPL itself - that's how the GPL works. This is still true if it's only available as an API due to it having also ingested AGPL code.

This was a joke, suggesting that copilot had injected GPL code into *gestures broadly at everything*.

It's not based on GPL code tho. It's based on code GitHub was granted a license to analyze - which you grant them by posting code on GitHub. This code being licensed to everyone under GPL is a separate thing from the license granted to GH.

This doesn't solve the issue of copilot putting GPL code (or derived code) in a non-GPL repo (since I don't think ToS allowed GH to license your code to others), but copilot itself is probably fine from legal perspective.
