So contributions made by Copilot based on learning that code are derived works and should be licensed under the GPL, yes?
I'm only arguing that Copilot itself should be. That question is much more complex.

This is GitHub though, the proprietary SaaS derived from the GPL git tool. I will agree with you and not expect a freedom-preserving outcome.

I don't think that's really accurate - yes, it's "based on" Git, but it's not based directly on the Git code. They suck, but they've never done this before quite so egregiously.
