Here's a more clear cut question: did they include CC BY-ND and/or CC BY-NC-ND works? Because those licenses expressly forbid derivative works.

So if code delivered by CoPilot derivative; it should apply the original license. If it is not; apparently you can now launder Interlectual Property via an AI. Sounds like some fun implications.
