    To be fair, arresting people is what police do. The City chose to make officers the front line in this effort to “help.” The City’s political decision—not the individual decisions of individual officers—is what’s most responsible for this project.

    I know The Nation has a particularly liberal view, but I wonder whether conservatives know how much damage the bigoted opinion of Smith & Duncan has done to hurt the perception of that entire court. It’s 1 thing to issue decisions I disagree with. It’s another to be a mean bigot.

    Also notice the unsupported argument that 90% of the women are being trafficked. seems to accept the police department’s assertion without any verification. Maybe it’s true. Maybe not. But there’s zero way for the reader to know.

    Remember when Cindy McCain gave no reason for reporting a biracial family other than they were biracial? “If you see something, say something” is a horrible slogan that encourages people to sic cops on people based on pure racism & other personal biases.

    I’m glad this case ended well for the people helping the immigrants, but religious exemptions work for small minorities. If large majorities can disobey general laws based on religious practice, we’re going to have a hard time maintaining this level of accommodation.

    We liberals have trained ourselves to only give secular arguments to support our beliefs, even when our religious beliefs are key. But that’s going to have to change if courts continue to interpret religious freedom so broadly.

    Just got notice of two Ohio Supreme Court OAs in April—Tuesday here in Columbus & the next day at their off-site session in Steubenville. Off-site sessions are fun b/c they’re usually at high schools & they have lunch for for counsel, justices, and guests after.

    The elation of seeing your case in the list of accepted discretionary appeals in your state supreme court... then brought most of the way back to earth when you see briefing is stayed pending resolution of another case. At least the client still has a chance.

    Professor Eugene Volokh of is arguing a free speech case in the Ohio Supreme Court next week. Local counsel is my friend Karin Coble, whom Legally Speaking Ohio’s wrote was “in the top tier of oralists the blog has previewed.“

    In Ohio, a judge can impose a sentence of life without parole with zero explanation, and by statute the sentence can’t even be appealed. A judge can impose effective LWOP by running sentences consecutively and reading statutory findings verbatim with no further explanation.

    I suggested to the court that they wouldn’t be please if I quintuple billed them for travel time.

    I argued a case a couple weeks ago where the record shows that the sheriff several times served subpoenas to 5 law enforcement at the same time, but billed for 5 tripes instead of 1. The total overcharge was “only” about $50, but this garbage adds up.
