It's a bit disappointing that he assumes that some judges would be put in a bind. I think the more likely outcome, in case the EO is promulgated, is that every circuit rejects it and SCOTUS refuses to hear the case as their wouldn't be a circuit split.

The spirit of Antonin Scalia would be indifferent. The opinion he wrote in DC vs Heller mangles the text of the 2nd in a similar fashion as the proposed 'originalist 14th' argument does.
