As a private institution, I'm happy with them allocating admissions spots based on whatever criteria they like, provided that they do not flout federal anti-discrimination law. One guy's opinion: this is not a standard they're anywhere close to meeting at present.
Anyway, I fail to see why university administrators shouldn't try to do what they think is best for society. As employees of a nonprofit, what other mission do they have?

If the University of Texas can't produce any evidence that their affirmative action program improves overall outcomes what makes you think it's best for society? They have a big incentive to do so.
