Answer, of course, being that your employer can't force you to stay but can fire you cheerfully for evacuating or anything else.

Usually illegal but if full sleeping quarters provided some states have loopholes.

Everyone should read r/legaladvice, it's a great bird's eye look at how average people encounter the indifferent cruelty of the nation.

It's also a lot of men asking if they can get their gf to sign "abortion contracts" to waive child support (no), but that's another story.

What's scary is if you spend enough time reading it you can get snarky, like "lol this idiot thinks he can't get fired for NO REASON."

"HAH what a fool, he doesn't live in Colorado where there are some protections against being fired for legal activity while off the clock."

And where you DO have legal protection against getting fired for evacuating, they'll just fire you the next time you drop a tray of drinks.

It's easier to make a solid retaliation case than you might think, but it's a rare cocktail waitress who has the bandwidth to fight it out.

UNIONIZE!!! THEN THERE IS NO QUESTION!!!!
-
Yeah, I was in Florida when the last hurricane hit and I was in the union. We were told if we wanted to leave early, we had to use PTO--
-
--and if we didn't have PTO and left we'd still get the "occurrence" for lost time. I stubbornly stayed at work until--
-
--they finally let people go home early. My supervisors were pissed but I told them this was THEIR system.
-
All my union experience was while in Fl, and it's basically paying a fee to not be the first to get laid off
-
And this was two different unions at two different major companies. Unions aren't bad but they aren't great either.

My cousin runs a Lowes and corporate wouldn't let him close the store w/ an ice storm on the way bc Home Depot was going to be open.
-
He walked across the street to Home Depot to ask if they were closing. "Not if you're gonna be open." Handshake & everyone got to go home.
-
Hearing Home Depot & Lowes employees colluding together to undermine their corporate overlords is strangely heartwarming.

It's like the late stage capitalism version of the Christmas Truce. https://en.m.wikipedia.org/wiki/Christmas_truce …
