[1] Isn't it all about risk management? If money can be used as deposit for covering default risk no external law system is required.

Somebody or something needs to verify performance (or lack thereof), or in some cases automate performance.

Designing social systems with incentives to improve the groups cooperation is a hard challenge but I think that is they key.
