Honest ?: How does "we" pick out the attacker in the "malicious" group with certainty without accounting for innocents in the group?

By innocents I mean for example : An exchange or exchanges that are using stored users funds without their knowledge in the attack

I do hope that people would be made whole by the clients in a hf if (say) someone who is somehow surely know extra-protocol to be innocent..

But this is controversial enough that I wouldn't count on it. But also we can't remove the penalties without serious security compromises ;)

So basically this is everyones issue with the "we". We would be relying on human decisions and incomplete information to eliminate attacker.
