In a nutshell - base layer arbitration doesn't scale. Each chain should have a User Agreement, and network operators should offer an SLA to set expectations of their support. In DPoS, a Block Producer's SLA could be a way to differentiate trust with token holders & attract votes.

It was rushed and didn’t get the support of the 15/20+1 startup BP’s Like steve said, at this stage it looks like each side chain will develop its own ‘user agreement/constitution’ based on use case and jurisdiction This way BPs will be able to comply as local entities.

Arb should be at dApp level, agreed to on a case by case basis in the Ricardian contract users sign. Smart contracts should be immutable, & only editable by BPs under SLA terms offered. This removes people from the equation & treats the chain more like a business than a commons.
