        I didn't know that shoplifting was a capital offense. Or is this a case of stand your ground where the shooter feared he wouldn't get to have the item that was supposedly shoplifted. The power of the gun makes it possible to have a one person lynch mob.

        It seems open and shut, except the dude had a hatchet. Now he's armed. Im not making that case but thats what his lawyer will say without a doubt. Now he can claim reasonable fear. The kid shouldnt have been shoplifting, he didnt deserve death though. IMHO

        You can only use deadly force in defense of property in FL if the use of deadly force is necessary to prevent the imminent commission if a forcible felony. The dead guy was trying to leave. Grand theft - assuming the hatchet was worth more than $300 - is not a forcible felony.

        You can use force if you have a reasonable fear of death or great bodily injury. The kid had a hatchet, its a deadly weapon. Armed shoplifting is a forcible felony, it could also be considered aggravated robbery. That was the wrong item to shoplift.

        There’s no such crime as armed shoplifting in Florida. Ditto for aggravated robbery. Robbery in Florida can be enhanced as to penalties if the offender uses or possesses a weapon. But this isn’t that. This is theft of a weapon. That’s not robbery.

        The problem is its a weapon. If you arm yourself while committing a crime you put yourself in a bad situation, a dangerous situation. I doubt he thought about the implications of stealing that particular item. He should have just let him go, in time he will wish he had.
