        Specifically did you look into the legal concepts and requirements of "covered service", "implied consent" and "mandatory testing"?

        Holders of Commerical Driver's Licenses are in "covered service" & required to abide by federal drug testing regulations after accidents.

        All holders of a CDL involved in a fatal crash regardless of fault are mandated to be blood tested for alcohol and drugs.

        The driver gives his "implied consent" to testing by the fact of holding a CDL & engaging in the trucking business. No warrant is required.

        Interesting questions here are who the trucker's employer is (was he owner-operator?) & how mandatory testing works w/ unconscious subject.
