It made no sense for this section of private fence to be built where it was. We already owned the land a few hundred yards from the river and it cut the peninsula instead of following the river. 1/https://twitter.com/realDonaldTrump/status/1282276752090431490 …

I sued Fisher and WBTW asking for a restraining order because the location of their fence violated the boundary treaty and they didn’t do any engineering beyond a power point slide. 2/

What they built is one step beyond vaporware. We said it was too close to the water, erosion would be an issue, the location made no sense, etc. Now we risk the thing falling down in a big storm/flood. 3/

Tactically the fence makes no sense. There was no way to easily get a truck or mowers on the river side of the fence once the erosion started. If stuff starts growing on the bank and ruins visibility now what? 4/

Next, if a Border Patrol crew on the river has any issues, they have no dry safe haven for nearly three miles! Fisher didn’t put in any gates for law enforcement. 5/

But a judge said they could build their little fence. A fence we argued in the fall would have all these problems. This was a vanity project that We Build the Wall admitted they were only social media cheerleaders for. What a scam. 6/6

The levy wall has been there for decades. Throughout RGV where there is existing flood levy we build the fence on top and on the “dry” side.

The treaty concern is the boundary commission is supposed to prevent structures and man made efforts to move the boundary, the center channel of the river. In this case, Fisher cleared out the brush and built on the bank causing erosion.

Then if there is a large flood event like a hurricane that goes up the valley, the designed flood plain would be blocked by the private wall. Even it being a fence with pylons will mess with water flow.pic.twitter.com/MeKRNkVy8J

The water could back up behind the fence causing all sorts of damage. If the area within the fence fills up like a bathtub and cannot drain fast enough because the pylons impede the flow or more likely the pylons catching branches and other floatsam, then the fence could fail.pic.twitter.com/iDFnJCPBhN

The front of the wall (portion nearest our property) will clog with debris floating downstream, forcing water & sediment redistribution. In an event like Hurricane Alex, entire structure will be submerged IF it withstands the force of the H2O against a fully clogged trash rack.
