Justice Dept. said that assault is not a fed crime. Background investigation of SCOTUS nominee is their area but they can only complete it on instruction from WH. WH and Republican majority are afraid to have Kavanaugh discuss this w/FBI apparently.

@ChuckGrassley and other members of@GOP knew of the rape allegations and tried to protect#Kavanaugh rather than inform the@FBI (when did those 65 women sign the letter and what were they told?), does that make them co-conspirators in the cover-up of a crime? -

unbelievable that sexual assault, when charged to a potential Supreme Court nominee, is not under the purview of the FBI or another federal investigative body. Who can investigate it? the State police where the crime is alleged to have occurred ? If so can anyone pursue or order

The FBI investigates violations of federal law, so, pretty much everyone should agree it's not the FBI's role.

If he did it, and he lies about it under oath, it becomes a matter of federal law. I think that might be where they’re going with it.

And if any of them had questioned him about it while he was under oath, it might be a valid approach. Unfortunately, Feinstein sat on the document for 2 months before revealing it, and when it was revealed and she had him under oath, she didn't ask.

Because the victim wanted to remain anonymous. She isn’t going to out a victim that doesn’t want to be outed.

Which would mean something if she hadn't gone ahead anyway and released the document, 2 months later. And _after_ the document was released, she had him under oath, and still didn't question him on it. Thus, perjury wouldn't play a role here.

By the way, just to be clear, I do believe the allegation should be investigated, I just don't think it's the purview of the FBI to do so.

They’ll be questioning him on Monday. If he continues to deny it, but they find out the accusations are true, does that not reopen the case for perjury?

Yeah, need to prove the allegations first, though. But, the important point there would be they'd be investigating the perjury, not the as yet unproven allegations.
