It's easy to prove a negative. That's what an alibi does in criminal trials. People saying "I don't remember" is neither corroboration nor refutation. It casts some doubt on an accusation, but does not refute it.

To do that you need a time and place. It's impossible to have an alibi with no time and place.

Me too. I never suggested otherwise. We're not going to get clear proof, one way or the other, but we're going to have to make a decision anyway. I talked about "refuted" in the article because Kavanaugh said the accusations have been refuted and that's incorrect.

It means he should be confirmed, or at least that this accusation should not prevent confirmation. It would be incredibly ironic for a justice in the United States of America of all places not to be confirmed because he was assumed guilty unless proven innocent.

Never seen a cop show where the detective asks the defendant, "Where were you almost 4 decades ago, but we're not really sure when or where?" We'd all be in prison if we had to answer that question or face conviction.
