Douthat is accidentally right. As someone who explicitly argued that a different standard than due process should apply in Kavanaugh's case, I'm baffled that so many Americans don't think we should be tougher on people up for elite jobs, especially when there's other options. 1/2https://twitter.com/DouthatNYT/status/1042506243959599105 …

Kavanaugh's clouded by multiple questions of personal integrity (accused of sexual assault, questionable finances, dishonest with Congress and public). Gorsuch, Alito, Roberts weren't. Nor are many other potential noms. Why should we lower the bar? 2/2https://arcdigital.media/everyones-applying-the-wrong-standard-to-kavanaugh-s-nomination-9b5859209039?source=friends_link&sk=4973bf2f07aec042d2ede336c92a5dca …

Absurd that so many are yelling “innocent till proved guilty!” That’s the criminal court standard. Civil court standard is less strict (probability.) Public opinion court even less. Job interviews less again. Lifetime seat on SCOTUS? Surely not criminal court standard.

Exactly. If we were talking about putting him in jail, that would require beyond a reasonable doubt. But we're not. We're talking about whether it would be best for the country if he's elevated to the Supreme Court, rather than someone else nominated by President Trump.
