You could argue Kavanaugh's punishment is less or minimal because he's prominent (ignoring the reputational harm) but you said it was "not" a punishment, none. That's the principle we're testing: whether non-advancement is punishment.

Even without the sexual assault accusation, Kavanaugh has proven himself to be a liar. Reread the section titled “Honesty.” Using the standard Mr. Grossman gives, Brett Kavanaugh should not be on the Supreme Court. There are way better candidates. Example: Merrick Garland.

Also, if it's really just about the allegations, why does he need to be up for promotion? You've got the 5k, and producing an allegation is supposedly easy (your stance, not mine). So let's see it. Show, don't tell.

He didn't claim firing wasn't a punishment, just non-advancement. It wouldn't be a good test (or fair) to risk his firing.
