The prevalence of this Harry Reid filibuster take is amazing. I wouldn’t have thought anyone really believed it, but it just keeps coming up, including from some smart people. Motivated reasoning + information bubble = unexamined conviction

Reid nuked the filibuster for non-Supreme Court noms after GOP filibustered all of them, without exception, regardless of qualifications, and would not cut a deal. What were Democrats supposed to do? Respond to this unprecedented move by leaving every judicial vacancy open?

Both sides play politics with judicial noms Democrats started filibustering all of Bush's court noms. But when GOP responded by threatening to nuke filibuster, Dems cut a deal, let some judges through. If they didn't deal, you really think GOP would've kept filibuster? Should've?

Here's the reality: As partisanship increased, both parties increasingly obstructed nominations. The judicial filibuster was a dead letter. As soon as the minority used it to block a Supreme Court nom and refused to deal, the majority would eliminate it. "In sorrow," of course.

But even if you think Harry Reid indefensibly nuked the filibuster, that doesn't require escalation. Upon winning the Senate, GOP had many options. Reverse Reid's action, follow it directly, work to restore compromise on judicial noms, etc. They're responsible for their choice.

I kinda wish Dems refused compromise under Bush, so GOP would've nuked first. I wouldn't have liked that, then or now. But at least we wouldn't have to hear otherwise intelligent people make such weak, responsibility-shirking arguments about Reid and the filibuster today. (END)
