@NEratepayers has asked the@FERC for a declaratory order stating that SB365 is preempted because it is inconsistent with the Federal Power Act and the Public Utility Regulatory Policies Act (PURPA). If you live in New York, for every dollar you pay in 911 fees on your phone bill, the state takes 90 cents and spends it on things *not* related to 911. In 2017, that meant $170M diverted out of $189M collected from consumers.

I respectfully disagree with this characterization of what
@EversourceNH is doing re SB 365. https://www.unionleader.com/news/business/eversource-balks-at-state-law-ordering-it-to-buy-wood/article_d80dc804-27af-5f47-a4e1-15e910d87c9f.html … At the PUC yesterday, Eversource made clear it WILL comply with SB 365. And it is not challenging the constitutionality of the law, unlike@NEratepayers or OCA.Thanks. Twitter will use this info to make your timeline better. UndoUndo -

@DMoKreis joins@NEratepayers in@FERC Petition for Declaratory Order requesting that FERC find that NH SB 365 is pre-empted by the Federal Power Act and in violation of PURPA. If implemented SB 365 would cost NH ratepayers $25-30 million/yr. https://energynews.us/2018/12/17/northeast/new-hampshires-biomass-law-overcame-a-veto-but-can-it-clear-ferc-scrutiny/ …#NHpoliticsThanks. New England’s legislators need to read this—no need to pay $80-$90 per MWh for solar when utilities in other states are paying a third of that.

This pretty much sums up economics of municipal solar. Contract w/third party who can take advantage of ITC/PTC and support policies that pay NEM power at well-above market rates so you can overbuild and profit from regressive cost-shifting.
