    So, with my not-a-lawyer hat still firmly on, looking at the numbers and looking at the case law it would seem to me that an individual employee offering personal time to improve representation for a group that is statistically under represented isn't discrimination

    In United Steel Workers of America v. Weber only 1.83% of the plant's craft workers were black. They reserved 50% of the openings until Black craftworkers in the plant was commensurate with the percentage of Blacks in the local labor force. This was upheld by the supreme court
