So when the news broke that DoJ wasn’t going to use those two trump documents found in the storage shed in their criminal probe, that supported my contention that simply having classified in your house isn’t a crime. A crime would require willful possession of the documents. 8/

When the two additional trump documents were found in the storage shed, I said that probably wasn’t a crime because trump likely didn’t know they were there, and they probably weren’t commingled with anything trump used after he left office. 7/

DoJ explained the importance during its fight to vacate Judge Cannon’s order appointing a special master saying the non-classified is needed for their criminal probe into Donald in the documents case. DoJ won that and trump appointees in the 11th circuit agreed. 6/

DoJ needed the non-classified that was seized alongside the classified, and DoJ pointed out 3 specific docs commingled in trumps desk with some classified documents. Namely 3 letters from an author, a religious leader, and a journo that were dated after he left office. 5/

See, in order to be criminally liable for possessing classified documents, DoJ has to prove you knew they were there, and one way to do that is by proving you actively possessed them. One way to do THAT is by proving they were commingled with stuff you’ve recently handled. 4/

My assessment was based on multiple interviews with people who have investigated the spillage of classified info, along with arguments DoJ made to the 11th circuit to get the NON classified documents back from the special master. 3/

For a little background, I tweeted this a few days ago in response to a question about the legality of Biden having classified documents found in his home and office. The point being if Biden didn’t know they were there, that’s not a crime. 2/
