      My kid works at McD’s. If store not “up on the day” (profit v costs) when checked (hourly?) staff sent home. No pay, no notice, for them. My 17 yo now doing work of 2, sometimes 3 people. 3.5 hr shifts so no paid break. $14/hr.

          Re: 3 hour rule— A loophole you could drive a truck thru, and which requires an employee with some power to even complain about: Exception to rule OK “in some cases where the cause of the employee not being able to work at least three hours was beyond the employer's control.”

          The Employment Standards Act is a pathetic anachronism, and any protections it does offer requires workers with sufficient power to file complaints. Which of course describes few workers *with* a collective agreement, and none without one.

          Agreed! According to an employment lawyer I once consulted, basically said as much, that the ESA is useless to anyone outside a collective agreement or subject to human rights.

          Last time I checked it was 5 hours. My son worked at the local Can. Tire and got no break on a 4:30-9:00 shift. Even though he was relieved at 9:00 and still had to cash out the til which sometimes took a half hour.
