thanks! I’ve been reading the Teles book and finding it very helpful. I’ll look at the TNR article.
also much of the pro-electing judges scholarship (as by Chris Bonneau, Melinda Hall, et al.) is implicitly about this, since it's underwritten by conservative interests who are interested in winning state judicial elections. there's a whole academic industry built on this
