There's a distinction between theft, which is the unlawful taking of property, and burglary, which is the unlawful entry of a property with the intent to commit a crime. A person doesn't have to unlawfully take property in order to commit burglary.

You overreached a bit on this one. It’s tough to justify a burglary charge against someone stealing from Walmart during business hours. The entry itself was pretty clearly lawful. It’s the theft that isn’t. And theft without burglary should be a lesser offense.
