I can see where "my family" is on topic in elementary art class: I brought home a bunch of "my family" pictures, family trees, etc around that age. But if you're willing for all teachers to act like they don't have spouses, that's one way to be fair, even if I think it's a lot.
I don't want a kid shamed in school for choices that adults made

I'd say that kids are more welcoming and understanding to Family Trees. They are curious and trying to put the pieces together. They start with facts and add feelings with the help of their adult caretakers. ... but yes, why do this in Public School?
