2/ the word "process" in the phrase "due process" refers to procedures. This is Kegan 4 stuff. We, as a society, should not want to reach the "right conclusions". We should want to reach the right conclusions while following the proper procedures. This sounds legalistic >>>

3/ ...but forms matter. We don't want the airline mechanic to put the right seal in the jet engine ... we want him to scan the barcode on the plastic bag, verify the the holographic seal, open the bag using rubber gloves free of grit, install the seal using the right tool...

5/ I agree that the courts are inefficient. It's not the process itself that I have a problem with. Just the fact that if you've got money and solid lawyers, you can delay every step of the process. E.g. getting court dates rescheduled over and over so your trial gets bumped out for years. Not everyone can do this.

The problem isn't the procedural bullshit, its the artificial scarcity in arbitration resulting from it's monopoly privilege in the market
