People say this a lot but I don't think small town and state lawmakers are consistently hypocritical enough throughout history to write laws like that even if they shift in practice to have a large gap between enforcement and the text.

NYC passed an ordinance against drinking in central park, to keep the books clean of its anti-destitute intent, it wasn't written into the law, lawmakers assured it would never be used against someone enjoying a glass of wine w/ a picnic. Guess how it's enforced now?

I'm not denying that laws on the books can drift in intent and enforcement. In fact that's exactly what the conversation is about! I just don't think the majority of laws written over hundreds of years were written with the dishonest intent of achieving some other goal.

Ah sorry for the misunderstanding, I largely agree. But I also believe that sexual practices are one of the places where the laws would have particular proclivity to saying one thing and meaning another. I'd expect many sodomy laws had a hidden rider of don't let us find out.

I guess it's possible people are reluctant to talk about sexual stuff even back in the day, but like with the anti-destitute example, plenty of places used to just have really forthright anti-vagrancy laws!
