Seems to me the line where it becomes like property is when a 3rd party gains access. It's a breach of contract to give access to the 3rd party (rip a purchased CD, put it on Napster). But if the 3rd party is a criminal for downloading and sharing, it looks a bit like property.

I don't see how ip is a legit contract right. it's alleged to be binding on persons who don't seem to have agreed to anything.
