The latter. It's there, but don't take the statute at face value (unless your lawyer says you can, in which case yay!).

the statute only extends qualified immunity (called "official immunity" in NH jurisdprudence) to state officials. town officials only have protection via common law my lawyer has not yet said "oh, yeah, this is likely / a good case / etc" but lawyer friends have said >>>
