2/ I exaggerate a bit for effect. A large part of the purpose of a contract is to make expectations clear, legible, and mutually understood ahead of time.

Gotta strike a balance between penalizing breach/nonperformance by making it hurt enough AND allowing parties to exit without coming to blows in the event of a breach.
