Eh, I think that there's no moral basis for retribution. Reparation is nice, but criminals usually don't generate any utility. Rehabilitation is mostly impossible. There is good evidence to suggest justice in the form of retribution is a form of altruism. It has a cost, there is no economic benefit, and yet without it anarchy is the most likely consequence.
