2/ During the trial, my neighbor had absolutely no need to open his mouth....and yet he did. And he said something that, IMO, absolutely undercut the eventual variance application. Checked the transcript today - yep, it was JUST as good as I'd remembered. The variance is DOA.

3/ No, small town politics - even though I've got him dead to rights, the good ole boys may choose to violate the law again and grant a variance. BUT If they do, appeals courts do not consider new evidence - just the record layed down in the zoning board meeting. SO
