having rioting supplies is quite plausibly a crime ; c.f. "burglary tools" having lawyers on retainer is legal for both rioters and lawyers lawyers can't help you plan a crime or hear of it in advance, but it's not a crime until it occurs. Compare LTC holder having an attorney

I'd also add that our system is predicated on the idea that everyone has the right to a defense attorney ... and actual criminals need that more than anyone else! The defense can do a society good even for bad people, but shooting down the bogus charges while valid ones stick
