the amount of Disney fan fiction out there... from which those indie artists would be able to profit if we didn't have this restrictive copyright regime crafted around IP as a corporate asset 😠

2/ so @sonyasupposedly is doing a communist kind of analysis: "given that factories exist ab initio, the way we should deal with them is ..." which ignores the incentives that create factories in the first place

3/ Putting $100 million into a new IP property to make a flagship movie is like putting $100 million into developing a new drug - you're PROBABLY going to lose money, but you do it bc if you win, you capture 100% of the upside (including spinoffs), for a certain length of time

4/ To say "anyone can 'homestead' IP after it's been laboriously (a) created, (b) spread to the masses so as to create a cultural Schelling point" is to say "the incentives from successful creation are reduced; tails you lose, heads you win 1/10th of your bet"

7/ So to some degree advertising campaigns aren't just about driving people to a particular movie, but about driving them to a movie in such numbers that the movie becomes the focal point of culture https://en.wikipedia.org/wiki/Focal_point_(game_theory) …

10/ Disney has not "enclosed" any of these things. You can go and make Sleeping Beauty movies, books, or fanfic. They have only made one example of the uncopyrighted tropes.https://twitter.com/michaelabuckley/status/1280205764137816064 …

Disney is a terrible example of this. Much of their money comes from enclosure of previously public work: Sleeping Beauty, Pinocchio, The Littlest Mermaid. Even Lion King was just a rip-off of Simba that they'd never tolerate in return.

my bet is that owning attention flows is much more valuable than owning IP, and further that you *can* own attention flows without owning IP in this case it's very literal: I own http://wanderverse.org , which is analogous-ish to owning a FOSS project repo

Kind of weird how lots of people say "yeah, intellectual property has lots of downsides, but without it, how would we do pharma development?". Weird because from my point of view, pharma presents one of the *strongest* cases for IP being harmful.
