Looks to me like he was the one assaulting and so far as I know, they were within their rights in their attempt to detain him. Stupid all around.

You can tell he was being detained and assaulted by the three car lengths he had to run to engage the armed man. This entire event was just a clusterfuck of bad decisions by everyone involved.

You'd have hated the middle ages, when apprehending felons was on the civilian bystanders, generally speaking. Some even say the practice of killing roughly 2% of each male generation, half by execution, half during commission of a crime, had a salutary effect on the genepool.
