It seems like the ex-cop angle might become relevant since the law that permits the pursuit explicitly states "felony" and an ex-cop is more likely than the average person to understand the distinction between that and what looks like simple trespass.

Cops literally get a free pass on everything. They call it Qualified Immunity. "I didn't know you couldn't beat man to death with a golf club for jaywalking." "Well since we've never had a case involving that specific incident, you couldn't have known. You get a pass this time."
