If I were to play devil's advocate, I'd say that libertarians aren't defending the common law of land (and its statutory outgrowths), but advocating a society where a freehold gives you unqualified right over that land, such that a person's freehold is their castle
They'd likely accept that an owner should be able to divide up this right into various sub-rights, and for instance sell to their neighbour a restrictive covenant against building up until they reach the boundary of their own property.
But they'd say the sort of right which should exist as default in the land is this unrestricted castle-like freehold, and if the holder of the freehold hasn't expressly consented to that (by alienating sub-rights themselves or buying the freehold lacking these sub-rights), then
it is the illegitimate coercive imposition of the state which is depriving them of the proper extent of their freehold.
If we say that historic state meddling renders invalid any infringements on X, doesn't state theft of land from natives 250 years ago also render invalid the basic right to own X at all?
Actually I think it might, but then to concede that would be to give up any feasible libertarianism
