Yes! However, if zoning already eexists then it means that the simple bundles of rights have be4n complicated by transferring away my right to, say, build a gas station, but in return, giving me a new right to not have such built near me. >>> https://twitter.com/_S70DD/status/1216522153035694080 …

2/ Debundling rights and rebundling them into new packages is a fine thing, and the source of much wealth creation. Ideally done via the free market, but not always. But given that government exists, and given that I purchased rights/ property bundle consisting of W, X, Y, Z

3/ Then I will get upset if a government official - in violation of the law - says "you know what ? I'm talking asset X from that bundle and handing it to someone else. Because I say so." I will petition politely. I will file objections. And, finally, I will sue.

4/ I do this not just because of the monetary value of asset X to me, but for the game theoretic reason that one never pays danegeld, one never surrenders a right to the government without a brutal knock-down, real-life fight. Making their BS costly to them reduces the quantity

5/ You continue to not read what I've wrote. I'm suing the town for violating the law. If you want to think that me suing the government to force them to obey the law that the citizens voted for is a win for government, feel free. https://twitter.com/_S70DD/status/1216535578117885952?s=19 …

6/ The town DOES have a zoning code. Adopted by a majority vote of the citizens. I read the entire thing, cover to cover, before choosing to buy this house. One government employee chose to ignore it and approve an eyesore 18' from the property line.https://twitter.com/PurpleProz/status/1216550588705472512?s=19 …

They didn’t approve a variance for the setback? If not, then it sounds like the permit should be rescinded.

is anything stopping them from issuing a variance to your neighbor now, and cutting the legs out from under your lawsuit?

Yes. Me, challenging them, plus my lawyer. I've got a massive game plan. Discuss on phone some day

Variances have to show extraordinary circumstances (I.e. topography, lot configuration, limitations due to natural features, etc.). Unless they could show substantive compliance with the findings, the variance can also be challenged.

Yep! Also, NH has a 5 point test before a variance can be issued and I think they fail 3+ points
