Also practical if they do have a hat out and are busking. There's a group of guys who perform in New Orleans who have a great line when they pass the hat: "You can tip us now or in an alley off Bourbon St later tonight. Your choice."

Big difference between busking in a nice open square where there is room for bystanders to walk past, disengage, etc., and a captive audience with 2" of clearance between heads and swinging feet / shirtless bodies.

This is an argument that 0.1% get to inflict their behavior on everyone else...basically a defense of the Tragedy of the Commons. The definition of private property / rights is a political act. Noise ordinances, zoning, etc. This is a choice.

Recognition that 0.1% will inflict their behavior on everyone else. We won't change human behavior, so the alternative is draconian police presence or monitoring in those public spaces, leading to other abuses. Better 10 buskers fling sweat than to punish 1 innocent commuter.

The commuters have formed their society and accepted it. As an occasional visitor to their exotic land, I find it entertaining. I fully support the people of foreign lands I might visit maintaining their unique cultures and traditions for my entertainment.

FWIW, I'd probably slightly prefer a private subway that allowed some forms of busking/public performance, but ain't no way to square this circle as long as no one/everyone owns it.
