2/ On the one hand, I am against the death penalty. On the other, there's no arguing with the eugenic effect of removing the 1% dumbest / most violent from the gene pool each generation.

I've heard the case that executions were critical eugenic force in earlier times contributing to human domestication. I speculate that incarceration is somewhat eugenic today. Can and do still reproduce, but being separated from women for a time must have some effect.

Obviously they do, but that says nothing to address my point. Take two criminal men of roughly equal attractiveness/status. One spends most of his 20s/30s in prison, one somehow lucks out and mostly avoids prison. I would guess the lucky one fathers more children on average.
