I appreciate the distinction, but I don't think it solves the problem. It just pushes persecution for speech back to "prosecutorial distinction", where we end up with end results like "every rainbow flag burning violates 'peaceable assembly', but no US flag burning does".

If flag burning isn't expression, but instead an action, the a flag isn't a 'symbol,' its a mere object. You can set your own legally-acquired property on fire, if it poses no danger to others. The ONLY REASON anyone cares is because both the flag and the burning is symbolic.
