GP I'm fine in theory with legalizing weed at the federal level by giving states the option to do so should they like. But the notion that we should wipe out weed related convictions predating legalization? No.

GP You committed a crime. Why should you be exempt from the consequences of your acts? How is this different than, say, if we legalized sexual assault?

It's different in that sexual assault has a victim. I'd support, at the end of prohibition, freeing people who were jailed during prohibition for drinking. I'm not arguing that it's a sacred principle, but it's a fine policy decision.

It's hard to know where the line is without digging into the facts of each case. The legislature and the courts can do their best to highlight such a line, but you will always be able to second guess any decision they make by coming up with a unique hypothetical.

GP Sort of my point for leaving the convictions of record even while freeing the incarcerated. Let them petition for expungement individually.

I think that electorally you could create a bright line that saying that possession without exacerbating factors like resisting arrest, intent to distribute, driving under the influence, multiple repeat offenses etc etc, there should be automatic expungement.

At this point we really are arguing 6 of one half a dozen of the other. But I prefer the onus to be on the state and the courts to argue as to why this thing that (at least culturally) has been no big deal for a while now, should continue to stain ones record.
