I'm a fan of bringing back "mens rea", but I'm also a fan of harsh sentences for everyone who joins an armed raiding party. When Vikings attack a monastery intending to murder, if they're caught, even the oarsmen should face the noose.https://twitter.com/davidminpdx/status/1098715366090362880 …

"intending to murder" - That's conspiracy, not felony murder.

Yep. I ran out of chars before I got to "and if we want to reorganize it for intellectual consistency, while keeping the punishment, I'm OK with that."

Perhaps I'm missing your point. The difference between conspiracy to murder and felony murder isn't just one of terminology or categorization. There's good reasons why we might want to punish one more harshly than the other.

my point arises in conversations with bleeding hearts, who argue "OMG, they're punishing Leroy for murder, even tho he never even touched a gun!!!" what'd he do then? "well, he picked the victim and drove the gunman there, but he only intended to rob him" ok, and problem is?

and the bleeding hearts never quite answer, but basically they're upset that Leroy is getting punished at a level appropriate for murder, when ALL HE DID was join a murderous raiding party intending to steal / threaten / MAYBE kill people
